I do agree with everything you have said. I would just keep it exactly at it is (font, thickness...) but adding the "the" outside the circle. And maybe, as Chris suggested, and Danielle has done, inverting the black and white.
The intention has to be clear -as Mike explained in his little manifesto about the creative commons.
